The Assam authorities has determined to repeal the private legislation governing marriages and divorces amongst Muslims in an enormous push in direction of a Uniform Civil Code (ICC).

Formalise Registration

The present legislation permits voluntary registration of marriages and divorces amongst Muslims. It’s not necessary underneath the legislation to register such cases. The registration equipment too is casual which offers for a scope for non-compliance with extant norms, stated Mr Sarma.

No Extra Muslim Registrars

Muslim registrars holding licenses to register marriages and divorces locally will not be capable to register marriages and divorces as soon as the legislation is repealed. Mr Baruah has stated 94 Muslim registrars, who’ve been registering marriages underneath the legislation, can be given a one-time compensation of Rs 2 lakh.

Custody of Registration Information

After the legislation is scrapped, the district commissioners and district registrars may have the “custody of registration information”, in line with Mr Sarma. The registrations can be finished underneath the supervision and management of the Assam Inspector Common of Registration. At the moment, the 94 Muslim Marriage Registrars maintain the authority to be the custodians of such information.

Stop Youngster Marriages

Sure provisions within the present legislation permit marriages to be registered even when the bride and the groom haven’t reached the authorized age of 18 and 21, stated Mr Sarma, including that its scrapping will mark a major step in direction of stopping baby marriages in Assam.
